Investors may be underestimating Apple's value in 2007 in contrast to 2006, according to American Technology Research analyst Shaw Wu. "As we look out over the next 6 to 12 months, consensus estimates, in our view, look reasonable, and will likely prove conservative, a very different scenario than in 2006," he said. "One of our key concerns on Apple in 2006 was that we believed published consensus estimates were too aggressive -- particularly revenue."

An online movie distributor on Friday filed suit against Apple, Google and Napster for alleged patent infringement. The plaintiff, Intertainer, claims the companies are treading on its intellectual property by infringing on a patented method for distributing digital entertainment over the Internet. The trio of technology titans are tapping the technology without permission, according to Intertainer's complaint filed with a federal court in Marshall, Texas. Neither Apple, Google nor Napster could immediately be reached for comment on the lawsuit.

Apple, served with 11 suits in the past six months, looks to be headed to the courtroom this year. Several of these suits relate to its backdating of options; others deal with antitrust and patent issues. One case, Tucker v. Apple Computer, alleges that Apple is violating antitrust law because content purchased from iTunes can only be played on the Apple-manufactured iPod and no other device. In another, PhatRat Technology v. Apple Computer, PhatRat alleges that the Nike + iPod product offering infringes on several of its own patents.

As Apple moves more and more into consumer electronics, its tendency to favor image over substance and block serious technical cooperation with enterprise customers will become more and more at odds with what it takes to deliver a robust Unix OS. Apple tends to hide behind its marketing communications division, a group of people who shudder with fear when presented with technical material to publish. So they water it down until it becomes useless.
